RULES OF THE “KITSUNE MAISON 7” COMPETITION
ARTICLE 1
Kitsuné France, whose registered office is located at 52, rue de Richelieu – 75001 Paris and which is registered with the Paris RCS under number B 504 894 528, is organising a competition called “Draw your face! Be the first to receive all Kitsuné music content and your drawing will feature in the Kitsuné collection”, on the occasion of the release of the new Maison 7 compilation album.
The competition will last from June 1 to August 31, 2009.
ARTICLE 2
Any adult person wishing to participate in the competition, who resides in any country in which the Maison 7 compilation will be sold, can enter this competition free of charge and with no purchase obligation; Kitsuné France personnel and the members of their families are not allowed to participate.
ARTICLE 3
To participate in the competition, participants must drawn their own face and send the drawing by Internet to lucky@kitsune.fr, which can be accessed by connecting to the Kitsuné France website at the following address: www.kitsune.fr/lucky.
Participants undertake that they will draw their own face. If they do not do so, their own liability could be incurred with respect to any third party concerned; in addition they guarantee Kitsuné France against any recourse in this respect.
Participants are required to indicate their personal details in the space provided for this purpose, otherwise their participation will not be valid.
Only drawings sent before midnight on August 31, 2009 can be included in the competition; the date and time of the e-mail will attest to the sending.
ARTICLE 4
The winner will be selected from among all the drawings received by a jury composed of:

Mrs. Audrey Castel, representing Kitsuné
ARTICLE 5
The winner of the competition will receive:
one year of Kitsuné music content:
At the end of every month and no later than on the 7th of the following month, Kitsuné undertakes to send the winner (by post at Kitsuné’s expense) all the vinyl record and CD releases produced by Kitsuné which were released commercially in France during such month.
The Kitsuné vinyl records and CD included in the winner’s prize will be those with a commercial release date in France between September 1, 2009 and September 1, 2010 (for information, as an indication, as of today’s date the label anticipates that it will produce and release between 20 and 30 different vinyl records and between 5 and 10 different CD over such period).
The winner therefore undertakes to provide Kitsuné with his/her postal address to receive the prize.
In addition, the winner authorises Kitsuné France to reproduce his/her drawing for commercial or promotional purposes on the sleeves and all promotional documents relating to the future albums of sound recordings produced and exploited by Kitsuné France. The winner guarantees Kitsuné France against any recourse in this respect.
ARTICLE 6
The winner will be informed personally. The participants’ personal details will undergo processing to enable the organiser to contact them individually if it became necessary. The data may be communicated to outside organisations if the participants give their express authorisation by ticking the box provided for this purpose on the site www.kitsune.fr/lucky. In accordance with Article 27 of the information processing and liberties law of January 6, 1978, the right of access and rectification of the data may be exercised with Kitsuné France, 52, rue de Richelieu, 75001 Paris, France.
ARTICLE 7
Participation in this competition implies acceptance of these rules without any restrictions or reservations. Kitsuné France reserves the right to shorten, extend, modify or cancel the competition if the circumstances require it to do so. Its liability may not be incurred as a result. Kitsuné France may also not be held liable for any loss of mail by La Poste. Any difficulty which might arise in connection with the application or interpretation of these rules or which might not be provided for in these rules shall be finally settled by the organiser; as a result, no claim or compensation will be accepted in the case of a modification.
Kitsuné France may cancel all or part of the competition if fraud in any form whatsoever is revealed, particularly electronically when participating in the competition or for the determination of the winner. In this case, it reserves the right not to award the prize to the persons guilty of fraud and/or to pursue the perpetrators of these frauds before the competent courts.
ARTICLE 8
The organising company reminds the participants of the characteristics and limitations of the telecommunications network and disclaims all liability with respect to the consequences of the participants’ connection.
In addition, its liability may not be incurred in any circumstances in the event of a problem in the forwarding of e-mails.
More specifically, the organising company may not be held liable for any material or intangible damage caused to the participants, their computer equipment and the data stored on it or for the resulting consequences for their personal, professional or commercial activity.
The organising company may also not be held liable in the event that one or more participants are unable to send their e-mail as a result of a technical fault or any problem concerning in particular but not limited to:
- network congestion,
- human or electrical-origin error,
- any malicious intervention,
- the telephone link,
- the hardware or software,
- any incorrect functioning of the software or hardware,
- a force majeure event,
- disruptions which might affect the proper conduct of the competition.
The Internet connection costs incurred to consult the rules and/or the competition time will be refunded on the basis of a 3-minute connection at the reduced rate of 0.15 euro, upon presentation of the appropriate documentation issued by the Internet service provider indicating the connection date and time. The request for a refund must be made to the address of the competition no more than 15 days after the competition’s closing date. Only one refund per household (same name, same address) is allowed.
ARTICLE 9
The complete rules of the competition have been deposited with Maître Jérôme Legrain, bailiff, 51, rue Rennequin, 75017 Paris and can be obtained free of charge upon request simply by writing to the following address: Kitsuné France – Jeu Concours Maison 7 – 52, rue de Richelieu – 75001 Paris (the cost of the stamp required to send the request to obtain a copy of these rules will be refunded on the basis of a stamp at the applicable second class rate).

REGLEMENT DU JEU CONCOURS « KITSUNE MAISON 7 »
ARTICLE 1
La société KITSUNE FRANCE, dont le siège social est situé 52, rue de Richelieu – 75001 Paris, immatriculée au RCS de Paris sous le numéro B 504 894 528 organise un jeu concours intitulé « Draw your face ! Be the first to receive all Kitsuné music content and your drawing will feature the Kitsuné collection » à l’occasion de la sortie du nouvel album de compilation MAISON 7.
Ce jeu interviendra durant la période suivante : du 1er juin au 31 août 2009.
ARTICLE 2
Ce jeu concours est ouvert gratuitement et sans obligation d’achat à toute personne majeure résidant dans tout pays sur lequel sera commercialisé la compilation MAISON 7 désirant y participer, à l’exclusion du personnel de la société KITSUNE FRANCE ainsi que des membres de leur famille.
ARTICLE 3
Pour participer à ce concours, les participants devront dessiner leur propre visage et envoyer ce dessin par le biais du réseau internet à l’adresse lucky@kitsune.fr après s’être préalablement connectés au site internet de la société KITSUNE France à l’adresse suivante : www.kitsune.fr/lucky
Les participants s’engagent à dessiner leurs propres visages. A défaut, les participants engageraient leur propre responsabilité à l’égard de tout tiers concerné et garantissent la société KITSUNE France contre tout recours à cet égard.
Les participants devront, à peine de nullité, indiquer leurs coordonnées dans l’espace prévu à cet effet.
Pour être pris en considération, les dessins devront avoir été adressés avant la date du 31 août 2009 à minuit, la date et l’heure de l’email faisant foi.
ARTICLE 4
Le gagnant sera désigné parmi tous les dessins reçus par un jury composé de :

ARTICLE 5
Ce concours est doté de :

Chaque mois, en fin de mois et au plus tard le 7 du mois suivant, Kitsuné s’engage à envoyer (par courrier, à ses frais) au gagnant l’ensemble des sorties vinyls et CD produits par le label et dont la sortie commerciale en France sera intervenue dans le mois.
Les vinyls et CD Kitsuné constituant seront ceux dont la date de sortie commerciale en France se fera du 1er septembre 2009 au 1er septembre 2010 (à titre indicatif, il est précisé qu’à ce jour le label estime produire et sortir sur ladite période entre 20 et 30 vinyls différents et entre 5 et 10 Cds différents).
Le gagnant s’engage donc à communiquer à Kitsuné son adresse postale afin de recevoir le prix.
Le gagnant autorise par ailleurs la société KITSUNE France à reproduire son dessin sur les pochettes et tous documents promotionnels relatifs aux futurs albums phonographiques produits par la société KITSUNE France et exploités par elle à des fins commerciales ou promotionnelles. Le gagnant garantit la société KITSUNE France contre tout recours à cet égard.
ARTICLE 6
Le gagnant sera prévenu personnellement. Les coordonnées des participants feront l’objet d’un traitement qui permettra à l’organisateur de les contacter de manière individuelle s’il en ressentait l’utilité. Si les participants l’autorisent expressément en cochant la case prévue à cet effet sur le site www.kitsune.fr/lucky , les données peuvent être communiquées à des organismes extérieurs. En application de l’article 27 de la loi informatique et liberté du 6 janvier 1978, le droit d’accès et de rectification des données peut s’exercer auprès de KITSUNE France, 52, rue de Richelieu, 75001 Paris, France.
ARTICLE 7
La participation à ce jeu concours implique l’acceptation sans restriction ni réserve du présent règlement. La société KITSUNE FRANCE se réserve le droit d’écourter, de proroger, de modifier ou d’annuler le présent concours si les circonstances l’y obligent. Sa responsabilité ne saurait être engagée de ce fait. La société KITSUNE FRANCE ne saurait être tenue également responsable de la perte du courrier du fait de la Poste. Toute difficulté qui viendrait à naître de l’application ou de l’interprétation du présent règlement ou qui ne serait pas prévue par celui-ci sera tranchée en dernier ressort par l’organisateur, de ce fait, toute modification ne peut donner lieu à une quelconque réclamation ou à un quelconque dédommagement.
La société KITSUNE FRANCE pourra annuler tout ou partie du présent jeu s’il apparaît que des fraudes sont intervenues sous quelque forme que ce soit, notamment de manière informatique dans le cadre de la participation au jeu ou de la détermination du gagnant. Elles se réservent, dans cette hypothèse, le droit de ne pas attribuer la dotation aux fraudeurs et/ou de poursuivre devant les juridictions compétentes les auteurs de ces fraudes.
ARTICLE 8
La société organisatrice rappelle aux participants les caractéristiques et les limites du réseau de télécommunication et décline toute responsabilité quant aux conséquences de la connexion des participants.
En outre, sa responsabilité ne pourra en aucun cas être retenue en cas de problème d’acheminement de courrier électronique.
Plus particulièrement, la société organisatrice ne saurait être tenue responsable de tout dommage, matériel ou immatériel causé aux participants, à leurs équipements informatiques et aux données qui y sont stockées, et aux conséquences pouvant en découler sur leur activité personnelle, professionnelle ou commerciale.
La société organisatrice ne saurait davantage être tenue responsable dans le cas où un ou plusieurs participants ne pourraient parvenir à envoyer leur e-mail du fait de tout défaut technique ou de tout problème lié notamment et non limitativement à :
- l’encombrement du réseau,
- une erreur humaine ou d’origine électrique,
- toute intervention malveillante,
- la liaison téléphonique,
- matériels ou logiciels,
- tout dysfonctionnement de logiciels ou de matériel,
- un cas de force majeure,
- des perturbations qui pourraient affecter le bon déroulement des jeux
Remboursement des frais de connexion internet correspondant à la consultation du règlement et / ou au temps de jeu sur la base d’une connexion de 3 minutes au tarif réduit de 0,15 euros sur présentation d’un justificatif du fournisseur d’accès indiquant la date et l’heure de la connexion. Cette demande doit être effectuée à l’adresse du jeu concours au plus tard 15 jours après la date de clôture du jeu concours. Le remboursement sera limité à un foyer (même nom, même adresse).
ARTICLE 9
Le règlement complet du concours est déposé chez Maître Jérôme LEGRAIN, huissier de justice, 51, rue Rennequin, 75017 Paris et peut être obtenu gratuitement sur simple demande en écrivant à l’adresse suivante : KITSUNE France – Jeu Concours MAISON 7 – 52, rue de Richelieu – 75001 Paris (le remboursement du timbre nécessaire à la demande de communication du présent règlement sera effectué sur la base d’un timbre poste au tarif lent en vigueur).
